Time Frame to File a Lawsuit

After an accident this is a question many victims ask and the answer is simple. You need to file your case within the Ohio personal injury lawsuits filing timeframes or risk reduction or denial of your claim.

The first thing to consider as you decide when to file your auto accident case is whether you are injured and should file a case in the first place. Cases with just property damage or a few bumps and bruises typically do not warrant a personal injury lawsuit. Have an attorney evaluate the case and discuss filing within the appropriate time period.

Ohio Personal Injury Lawsuits Filing Timeframes
The statute of limitations is a legal statute present in every state which creates the timeframes within which you are able to settle an injury claim or file a lawsuit. How much time you have to file your case is dependent on the Ohio statutes, which allows for up to two years from the date of the accident to bring a personal injury and wrongful death case.

Product liability cases must also be brought no more than two years after the injury, but cannot be brought more than ten years after the product was first delivered to a purchaser.

Medical malpractice also has different Ohio personal injury lawsuits filing timeframes. The action must be brought within a year of the injury or when it is discovered. However, a claim may not be brought more than four years after the date of the occurrence that led to the injury.

How much time do I have to file my case?
When deciding to file your auto accident case you shouldn’t be asking that question without the intent of acting immediately. If you have time to question the filing timeframes, you should be using that time to hire an attorney to help with your case.

As soon as you seek medical attention for potential injuries, start making plans for when to file your auto accident case. You should be seeing a medical professional about potential injuries as soon as you believe something is wrong due to your accident. Delaying treatment could be used as a sign to the insurance companies that your injuries are not severe or even that they are false.

Time is money – the longer you wait to file your case, the lower your chances may be to obtain a fair settlement. Talk to an attorney as soon as possible to make sure you’re not waiving your right to fair compensation for your injuries.
